Financial emigration was a pre-2021 South African Reserve Bank (SARB) procedure to change your exchange-control status. Tax emigration is the current SARS process of ceasing tax residency from South Africa. South Africa’s emigration rules have changed. The differences for SA expats in New Zealand are:
A formal application to SARB to change your exchange-control status. This allowed SA expats to cash out annuities and remit funds abroad. This process was abolished on 1 March 2021.
A SARS procedure where you officially cease tax residency from South Africa. You do this by submitting a SARS RAV01 form and declaring that you no longer meet SA’s residency tests. Only once SARS approves can you be treated as a tax non-resident.
In short, the old SARB emigration only affected exchange control, not your SARS status. Today, what matters is tax emigration – officially notifying SARS that you’ve left SA permanently.
All transfers from South Africa require SARS approval. If you’ve formally tax emigrated, you can obtain a SARS Tax Compliance Status (TCS) PIN and apply for an Approval for International Transfer (AIT) more easily. This tax non-resident status lets you transfer retirement savings, investments or inheritances out with minimal fuss.
By contrast, if SARS still sees you as a tax resident, you’re capped by your annual allowances and must prove your tax compliance. For example, receiving an inheritance while still a tax resident means you hit the R2m cap (subject to exchange control).
